House Oversight Committee Chairman James Comer opened an investigation into Delaware's proposal for Artificial Intelligence Companies on Monday. He sent a letter to Governor Matt Meyer requesting documents and communications by November 9, including internal AI chat logs. Comer expressed concern that the proposal could protect AI companies and investors from liability for reckless harmful actions. He suggested he may propose a federal law to limit states' regulatory authority over AI initiatives.

The draft bill allows AICs to operate in any lawful industry except banking. It designates AI agents to manage the business and affairs of the entity. A member funding an AIC is not liable for acts taken by the company unless specific exceptions apply. Delaware Secretary of State Charuni Patibanda-Sanchez co-wrote an op-ed in July 2026 announcing the proposal. She rejected the idea that the plan is a liability shield, stating they are trying to define where liability lands.

A spokesperson for Governor Meyer stated his office is reviewing the letter. Delaware officials state that an AIC would make AI agents accountable inside a supervised sandbox. Draft legislation is expected next year. Legal scholar Christopher Bruner questioned the lack of an overarching regulatory plan for AI-governed companies.
